Terms of Use

These Terms of Use (the "Terms") govern your access to and use of the hosted Shroud.email service at shroud.email and app.shroud.email (the "Service").

The Service is provided by Working Hypothesis Ltd ("Working Hypothesis", "we", "us" or "our"), a company registered in Scotland with company number SC890303. Our registered office is Third Floor, 3 Hill Street, New Town, Edinburgh, EH2 3JP.

By creating an account or using the Service, you agree to these Terms. If you do not agree to them, you must not use the Service.

1. The Service

Shroud.email is a hosted email privacy and alias service. We will provide the Service with reasonable care and skill and in accordance with these Terms.

We may maintain, update and change the Service from time to time. We will not materially reduce the core functionality of a paid subscription during its current billing period without a valid reason. These Terms apply only to the Service operated by us. A self-hosted copy of Shroud.email is governed by its applicable software licence and by the terms of whoever operates it.

2. Your account

You must:

  • provide information that is accurate and current where it is needed to create or operate your account;
  • keep your login details secure and tell us promptly if you believe your account has been accessed without permission;
  • use your account only for your own personal use; and
  • be responsible for activity carried out through your account unless it results from our failure to keep the Service secure.

3. Permission to use the Service

Subject to these Terms, we give you a personal, limited, non-exclusive, non-transferable and revocable right to access and use the Service. You may not sell, rent or otherwise make your account or access to the Service available to another person.

We and our licensors retain all intellectual property rights in the Service, its branding, website and documentation. Some of the software used to provide Shroud.email is open source and remains available under its applicable open-source licence. These Terms do not restrict any rights granted under that licence.

4. Acceptable use

You must not use the Service:

  • for any unlawful or fraudulent purpose;
  • to send spam, unsolicited email or automated email;
  • to send email or process information in a way that violates another person’s privacy, confidentiality or other rights;
  • to engage in abusive or deceptive conduct, including, for example, phishing, impersonation, scams or harassment;
  • to distribute malware or material that is unlawful, harmful, threatening or abusive;
  • to gain unauthorised access to the Service or another system or account;
  • in a way that could damage, disable, overload or impair the Service or interfere with another person’s use of it; or
  • to evade technical restrictions, security measures or enforcement action.

We operate a fair-use policy so that the Service can work reliably for everyone and our mail servers can retain a good reputation. You must not send bulk email or create aliases in bulk, including through automated means. A plan described as “unlimited” remains subject to this fair-use policy.

You must have the right to use any domain, email address, content or other information you provide through the Service. You are responsible for email you send using your aliases and for complying with laws that apply to it.

5. Plans, subscriptions and payment

Some features require a paid subscription. The price, billing period and features included in your plan will be shown before you subscribe and form part of your purchase.

Paddle.com Market Ltd ("Paddle") is the merchant of record for paid subscriptions. Paddle sells the subscription to you and handles payment, applicable taxes, billing and refunds. Your purchase is also governed by the Paddle buyer terms presented at checkout. These Terms govern your use of the Service provided by us.

Paid subscriptions renew automatically each year until cancelled. You authorise Paddle to charge the payment method associated with your subscription for each renewal. If the renewal price will increase, we or Paddle will give you reasonable notice before the renewal so that you can cancel.

You may cancel through the billing settings in your account or through Paddle. Cancellation stops the next renewal. Your paid features will continue until the end of the billing period. After that, you will not be able to create new aliases beyond the free-plan allowance, but your existing aliases will continue to work, subject to these Terms.

Because a free plan is available without a time limit, we do not normally offer refunds for paid plans. This does not affect any refund or cancellation right you have under applicable law or Paddle’s buyer terms. If you are a consumer, you may have a statutory right to cancel an online purchase, including during an initial 14-day cancellation period where applicable. Paddle administers cancellation and refund requests relating to your purchase.

If a payment fails or is reversed, we may suspend paid features after giving you a reasonable opportunity to correct the problem.

6. Availability, support and email delivery

We aim to keep the Service available, but we do not promise that it will always be uninterrupted, secure or error-free. Maintenance, technical faults, internet failures and systems outside our control may make it unavailable from time to time. We do not offer a service level agreement or service credits unless we agree otherwise in writing.

Email delivery depends on third-party senders, recipients, mail providers, networks, filtering systems and domain configuration. Email may be delayed, rejected, filtered as spam or fail to arrive. You should not use Shroud.email as the only way to receive urgent, safety-critical or otherwise irreplaceable communications.

You can request support by emailing contact@shroud.email. We do not guarantee a particular response or resolution time.

7. Your information and privacy

You retain any rights you have in information you provide through the Service. You give us permission to host, copy, transmit, modify and otherwise process that information only as reasonably necessary to operate, secure and improve the Service, comply with the law and enforce these Terms.

Our Privacy Notice explains how and why we use personal information. It is provided as a notice rather than forming part of these Terms.

8. Suspension and termination

We may restrict or suspend your account or particular activity if we reasonably believe that you have breached these Terms, failed to pay, created a security risk, exposed us or another person to legal liability, or threatened the operation or reputation of the Service or its mail servers.

Where reasonably possible, we will explain the reason and give you an opportunity to correct the problem before taking action. We may act immediately where necessary to prevent harm, comply with the law or respond to a serious or repeated breach. We may terminate an account if a serious breach cannot be remedied or if a remediable breach is not corrected within a reasonable time after notice.

You may stop using the Service and delete your account at any time. Cancelling a paid subscription does not itself delete your account. Deleting your account will stop its aliases from forwarding email and may result in permanent deletion of account data, as described in our Privacy Notice.

9. Our responsibility to you

We do not exclude or limit our liability where it would be unlawful to do so. Subject to that, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

The Service is for personal use. We are not responsible for business losses, including loss of profit, revenue, business, opportunity, anticipated savings or goodwill. We are not responsible for a failure caused by an event outside our reasonable control, but we will take reasonable steps to reduce the effect of the event and resume the Service.

10. Changes

We may change the Service for legal, regulatory, security or technical reasons, to prevent abuse, or to improve or adapt it. If a change will materially reduce paid functionality during your current billing period, we will give you reasonable notice where possible and explain any options available to you.

We may update these Terms from time to time. We will give reasonable notice of a material change, for example by email or through the Service. The updated Terms will apply from the date stated in the notice. If you do not agree to a material change, you may stop using the Service and cancel your subscription before it takes effect.

11. General terms

These Terms, together with the plan and price presented when you subscribe and any documents expressly referred to here, form the agreement between you and us about the Service. They do not affect any legal rights you have as a consumer.

We may transfer our rights and obligations under these Terms to another organisation, for example as part of a reorganisation or sale of the Service. We will tell you if this happens and ensure that the transfer does not reduce your rights. You may not transfer your rights or obligations under these Terms without our written agreement.

If a court or other authority finds part of these Terms unlawful or unenforceable, the rest will continue to apply. A delay in enforcing a provision is not a waiver of our right to enforce it later. No person other than you and us has a right to enforce these Terms under the Contract (Third Party Rights) (Scotland) Act 2017.

12. Scots law and courts

These Terms and any dispute or claim arising from them are governed by Scots law. The Scottish courts will have jurisdiction. If you are a consumer living elsewhere in the United Kingdom, you may also bring a claim in the courts of the part of the United Kingdom where you live. If you live outside the United Kingdom, you retain any mandatory consumer protections and rights to use local courts that applicable law gives you.
